Additional Child Support and Private School

My children's father was ordered to pay additional child support for private school that is not deducted from his salary. They have never experienced public school, so the court saw this as a practical option. I pay half of the tuition and he pays half. Unfortunately, only the standard child support is deducted from his check, and the tuition costs owed by their father is deducted from my paycheck. As a result, he has refused to pay. I do not have a paycheck now.

Horrible! I admit it sounds spoil, but we have two children with learning disabilities and one with muscular dystrophy. There is no extra child support for these characteristics, and we had both initially agreed our children would not attend public school due to these traits.

If the court order says he must pay this amount, then he's in violation for not doing so. However, the state can only take a percentage of his pay based on law. If this amount exceeds this percentage, then there's nothing that you can do right now.

If your kids are special needs as you had indicated, then child support may not stop when the kids turn 18 because their condition warrants long term care beyond the adult age.

If your kids can function just as well in a public school (special ed), then you may be asking for unreasonable compensation which may place the other parent in financial distress.
