CA Custodial Parents Pay 'Her' Child Support

The story you are about to read is true. It is in your best interest to stay as far away from California as you can if you have had a divorce with shared children.
My husband's ex-wife decided she was moving to Idaho. She said we could take the kids if she could keep the child support (NO JOKE!). We agreed. Fearing that we might lose the kids without a court ordered custody we took her to court, so we would be sure she would not get them on a 'visitation' and enroll them in school in Idaho (Remember, the kids as far as the courts are concerned are still in her primary care). We were granted 87% Custody, allowing her to see them only 65 days a year (she had some trouble with the law and was running). He set the support at zero. In California in order to change child support you file for modification of visitation, which allows for modification of child support. She took us back and asked to change TWO of the days which put us back in court to change support. Again the judge set it at zero. SHE TOOK US BACK. Each time she claimed she didn't have a job. My husband has done well for himself as an Air Traffic Controller with the FAA, and prior served 10 years in the Air force. She is a private chef, and claims to earn nothing as she does it all under the table. She asked to change ONE day. She claimed she didn't work. Her lawyer claimed my husband's 'POTENTIAL' earnings were 160,000.00 per year...Which is WAY OFF by about 40,000.00. The judge said she was capable of a job and they would go by "Idaho minimum wage". Showing her earnings at 800.00 per month.

For the last five years as per the court order, we not only pay her child support in the amount of 600.00 per month, but we are also to provide the children medical coverage (approx. 170.00/mnth). We still have 87% CUSTODY.
We are in the process of moving to Texas in August and hopefully we can have this changed. We don't even want her money, just the 8000.00 dollars a year we pay out for her 65 day visitation.
So before anyone wines about not receiving child support from the NON-CUSTODIAL parent, remember it could be worse...YOU could have CUSTODY and be PAYING the NON-CUSTODIAL PARENT!
