Assets: A useful or valuable quality, such as cash, long term investments, and real estate property.

Burden of Proof: A party’s duty to prove a dispute assertion to succeed or move on legal proceeding.

Child Abandonment: Leaving a child without any intention on returning.

Child Custody: The care and control of a child by his or her parent.

Child Support: Parent’s obligation to contribute to the economic maintenance and education of his or her child.

Civil Court: A court having trial jurisdiction over usually minor matters.

Cohabitation: Two people living together outside of marriage.

Common Law Marriage: A legal marriage that occurs without a license or ceremony when a man and woman live together for a certain period of time and hold themselves out to be husband and wife.

Contempt of Court: Attacking the integrity of the court and deliberately failing to comply with the legal process. Child support cases, refusing to pay, if father or mother is found in contempt for non-payment of child support, they could face jail time.

Divorce: A legal termination or dissolution of a marriage.

Emancipation: Freeing a child from the control of a parent’s relinquishing authority.

Father’s Rights: Legal principles and concepts supporting the idea that child custody and support decisions must not discriminate against fathers.

Hardship: A case of privation and the inability of a parent to support his or her children due to the lace of money.

Garnishment of Wages: Withdrawing the child support payments from the non-custodial parent’s paycheck.

Join Custody: Custody in which the parents share the responsibilities and decisions related to the child.

Lien: The legal right or interest that a creditor has in another property that last until the obligation is paid or satisfied.

Marital Settlement Agreement: Written agreement made by the husband and wife during a divorce pertaining to property, support, and custody of a child or children.

Non-Custodial Parent: Father or mother who has no primary or physical custody of their child or children. Also pays child support.

Obligation: Amount of child support paid by the non-custodial parent.

Obligee: A custodial parent who is owed child support from the non-custodial parent.

Obligor: Non-custodial parent who owes money (child support) to the custodial parent.

Paternity: The state of being a father, legally and biologically.

Sole Custody: One parent awarded both physical and legal custody.

Tax Intercept: The process by which a child support judgment debtor’s federal and state income tax refunds are diverted to pay past due child support.

Visitation: The right of a parent to visit a child as specified in a divorce or separation order.

Visitation Schedule: The time when a non-custodial parent has the right to see their child or children.

Writ of Execution: A court order authorizing the seizure of assets owned by the non-custodial parent.
