I had an ex girlfriend show up with a 12 year old boy and say that the child was mine. Of course I did not have any idea or prior knowledge of this child. I started a relationship with him and after a few months later, I finally convinced her to let me take him and get a praternity test. So I paid for that out of my pocket at $300.00. The report came back 99.999% so I was a father. I immediately put him on my health, dental and vision insurance. A relationship continued and eventually a relationship with the mother was established. We were one big happy family for about two years.

She took me to court for child support (which is not what I am upset about). So I pay my 20% a month but the judge is making me pay back child support in the amount of 35,000 for a child that I had no idea about. It was even admitted in court that I had no prior knowledge of this child. Then to top it off they took my income tax because of the money in the "Arrears".

Now according to the court documents I pay an additional $100.00 a month that goes toward the "Arrears" and it is drafted straight out of my check so I have never missed a payment. All I am saying is if I am paying according to the agreement, how can they take my income tax.

I will never have another child because if the mother does not want to be with me and leaves, then as a male in the State of Texas, I get screwed. Regardless of the situation males do not have a say so when it comes to child support rights.

My other question is, How do theses Judges get away with ignorant decisions and failure to be fair. I'm not against paying child support but I am against corruption.

hey baby mamas and baby daddys. I bet if sat down and talk you would come to realize what you're sending and what she getting are not the same thing. Those internet degree pencil pushing tax dollar wasting low lifes who work at the child support are just taking cuts of what's rightfully the mother of your children. I'm a daddy I know its my job to help my kids. But when I send their mother a certain amount I expect her I get every hard earned red cent. I don't have great job probably will never be able to find a better one. But if I send 350.00 dollar she should get 350.00 dollars not 300 or 349 no 350 period. Me and her are back together and we both want the AG office to get out of our lives because she didn't realize how much they were sticking in their own pockets and taking out of my kids mouths. And honestly to walk into of their office and see "customer service" on the wall kinda makes me ..... I don't want to say anything not nice. They only people they are truly servicing is themselves. I say fire the staff that can't be supported by the texas budget . I mean if they need money from outside source they shouldn't be taking it from my kids the people they're trying to help. They too overpaid and to overstaff walking to the office ask a question and having to wait 10mins while the workers behind the desk watch a viral video. Kinda makes me ...... (Find my happy place).... Anyways then to have look at me like I'm low life scum bucket because I'm asking a question even though the sign on the wall says "customer service" . I just wish me and my mother of my kids had been a lot smarter , not meaning using protection , I mean deciding to go to therapy instead breaking up and allow those bottom feeding urchins of society in our live! Cause hell it would have been a lot cheaper for therapy and a lot less stressful than trying to burn these leeches out of our lives. Child support laws in Bexar county unfair

Texas child support laws are very unfair I am married to a guy who did pay child support, but he was in the military and it said discretionary allotment. They did not consider this to be child support, and he now have to pay arrears to the mother even though the children are grown married have kids of their own and she has remarried. The only way he can get out of this is for her to forgive it and that is not happening, her desire in life is to try and make his miserable. I know all women are not that devious I am a wife and mother myself, but wrong is wrong and the system in his case has been very unfair. I don't understand why they take half of his social security to pay a debt that is not owed. But what is really unfair is that if they are going to take his money it should be a percentage not half of what he gets on disability, they don't consider the fact that he has a life too, and deserves to have a good quality of life. She gets social security herself plus half of his.

Time Period of Arrearages

A California Supreme Court decision (based on due process) limits the time period for establishment of arrears. Now arrears are only available going back to the date that the action was filed. Because it generally takes 1-3 months from the date of filing to get your case heard in court, arrears are typically charged for that period.

Unfortunately, that is the way Texas Law is. Even if you were ignorant as to the 12 years, Texas Law will show you as a non paying spouse or in this case..father. This law does need to be changed, since it is not only old, but also outdated. It takes people like you to take a stand, and get the changes made.

It is so typical that MOST of you men (not all) think it is a crime that you have to pay your child support. Let me clarify that the system sometimes works and sometimes does not work. In the instance of this man who did not know he had a child, I think he was treated very unfairly. He wasn't given the chance to pay support when the child was born and lost many years of precious time thanks to a selfish mother. I'm also sure there are some greedy, selfish mothers out there that use their support to get their nails done, go out and party, etc. Now, that being said, for the most part I think the system works to regulate support from the non-custodial parent (not just fathers). My ex-husband has continuously fell behind on his child support of $1,170 per month for our 2 daughters. However, when it catches up to him, it is always that I am being a greedy bitch. I don't think that wanting to keep a roof over their head, food in their bellies, and clothes on their back greedy. They have taken his income tax a time or two, but they also very quickly took back an overpayment made to me when he switched jobs and I was paid by both employers for the same period, which should have been corrected. My ex is now over $3,000 in arrears and is outraged because he applied for a passport and was denied due to child support arrears. Not my problem; he should have paid his support. I am not a lazy mother sitting on the couch depending on my ex to support us; both parents should work to provide for their children. I am a school teacher and I am in college for my Masters degree in order to continue raising my earning potential to provide my daughters with better things in life. My child support is solely used on my children and I would not be able to make it without it, even with my current salary. The system may be flawed at times, but it is better than no regulation at all.

The deal with the corruption in the Child Support division in the State of Texas has to do with the kickbacks the state gets from the federal government. The state receives 10% of child support collected from the feds as an incentive to collect more. The reasoning behind this is it's supposed to keep more off the welfare roles, supposedly. The men (sorry ladies-sad but true) are generally the higher wage earners so the women, not necessarily the better parent, are awarded custody so the state can collect more. This begins a vicious cycle. The girls then see this and decide they don't have to work and the boys are suckered in by having sex with these girls and the cycle starts over. My oldest daughter's mother recently passed away and I inherited a pregnant 17 year old. Then, to add insult to injury, even though the AG's office stopped garnishment on my wages for this child support, they sent me a bill of almost $2000 for arrears incurred when I was umemployed for 2 months, compliments of our wonderful economy. Who's going to reimburse me for expenses to bring this baby into the world when her mother, who never worked-just collected state and federal aid, was awarded by the state to be the custodial parent. She was uneducated and never cared to be and my daughter is following in the same footsteps.

Omg fathers come on now just pay the money and shutup you would not have been taken to court if you would have just payed your child support and for the ones that say I did not know I had s child please you are an adult that's why you should behave like an adult and use a condom you choose to have sexs and put your sperm in a girl and then your like I did not know I had s kid what did you think was gonna happen when you put your sperm in a vagina come on men use your brains and I'm sorry but I agree with the judged going back 10 years even if you did not know about the child its called taking responsibility of your own actions that is why before you have sexs talk about the possibilitys of children its the moral thing to do

Texas Child Support scam

We as fathers are being persecuted by the Office of the Attorney General of Texas, child support division. It is not the judge that makes the decition on child support. It is the child support divition. It is a money making scam that puts money into the pockets of certain people in that office. I was paying child support with arrears. My checks were garnished when I was working and my income tax returns were taken from me to pay it off. When I became disabled they took half my disability check. When I was done paying everything off, it took the child support office 6 months to stop the garnishments. No one wanted to help and fix the problem. I finally got them to fix the problem and they returned the money that was taken from me. That means that they used my money tax free for 6 months with out paying a % on money borrowed. You cant even take the state to court to charge them with the same or more percentage of money they took and used from you. The child support laws are there to keep women at home barefoot and pregnate. It does not help when the women we thought were going to be with us, turn out to be scaldelous and use any means necessary to get money without work. The only way we can have our voice herd is to start a group to take on the State of Texas. This can usually get lawmakers attention if there is a class action law suit. It might not go anywhere but it will get multi media attention which will get the govenors attention. Just an idea...

i dont think am confused i dont even know what to write I am writing this thinking about my next child support payment. courts in texas need to have consideration on all parties involved the kids the mother and the father, but it needs to be a fair consideration, am a father that pays child support and that suffers from different illnesses i always end up with no money for my medications and due to that am always getting fired from work for not reporting to work or for having to leave due to my medical conditions,then i get a very small paycheck and everything goes to my child support payment. how can i keep up with my payments and at the same time have enough money for my medications so i can keep a steady job and be able to support my kids,but i know that it will never happen cause am always feeling sick and with no money for my meds, i really love my kids and am glad and happy that i can provide for them and i also know that there a good mothers and also very good fathers out there that really care for their kids and that deserve to get child support payments, i just wish for the courts to find a way to help everybody in their situation. FATHERS, MOTHERS, CHILDREN we all have needs of a different manner and i think that the courts should consider and find a way to resolve each case in a fair manner for everybody. good luck to every mother and father whether receiving or paying child support.TIME FIXES EVERYTHING.god bless you all, our kids and the courts.

I look at it both ways. I have friend who is paying back child support for a child that he never knew he had and once she filed she moved to flordia. On the otherhand, I am a mother who is trying to get child support from the father of my child. He was a jerk and decided that he did not want to pay 250.00. Really 250.00 a month when you make of 6,000.00 a month is nothing. So I filed and was angry because now he is ordered to pay more then 50% of that. So....I don't know what to tell ya. The system is not perfect.

My boyfriend was out of work for 6 months due to the encomic hardship, He always made some type of payment with any of the money he made off of small jobs for cash here an there. He clearly made an effort but was not the full amount.
He was summon's to court for modification of child support an had currently started a new job. He made sure he had his check garnished for child support right away..
My boyfriend went to his court date, He reached an agreement with child support attorney's, soon as the judge returned from break he was the first to be seen. My Boyfriend was under the impression he was going to pay the new set amount an be done with court.
He now is an inmate at the Neuses County Jail, Corpus Christi, TX. The judge decided to give him 180 an over populated jail for back child support!
He has lost his job, everything. I am homeless because he provided for us both. I have tried to find work.... YOU TELL ME WERE IS THE JUSTICE IN THAT? HE HAS ONE CHILD AN PAYS HIS CHILD SUPPORT. BUT FOR WHATEVER REASON'S THE LADY JUDGE HAD FOR THROWING HIM IN JAIL WAS NOT BASED ON HIS CASE! NOW HE WILL BE FUTHER BEHIND AN JOBLESS ONCE AGAIN! WE CAN'T AFFORD A LAWYER. SO IN APRIL HE WILL GET OUT AN DO THE SAME THING ALL OVER AGAIN AN SEE THE SAME JUDGE AGAIN! THIS IS ALL A BIG MESS I NEED HELP!

My sons girlfriend just put him on child support. He lives in the same house, pays the majority of the bills, plus does all the cooking and cleaning. She has another guy living in the house (which at least keeps her in town. She used to go to his house in Hearne for two days in a row. On her days off.)This guy has no job and my son has to feed him too. What is worse is the baby is at my house 90% of the time. She just don't want to be bothered. But her pay check is not enough for her and her friends to party on. My son was never served and had no idea of the court hearing, untill he came home from work. Now it is done, he can not do anything about it, because he can not afford a lawyer.

My ex husband is over ten thousand in arrears, rode unemployment for a year without paying, got a job for three months and got laid off, went back to riding unemployment and lying to me saying he wasn't receiving any money so he still couldn't pay. Well, a while ago I had applied for state enforcement of my child support,(it used to be a registered case only which is hard to enforce) and the state finally took notice of his antics and is now garnishing a full 50% of his unemployment. This is much needed and a blessing to us. I am hoping they also take his income tax. He is so pissed that he is being forced to pay, that he is trying to move out of the state. I only hope that they find him and make him pay again. This man is a lousy person. I have two boys and one is severely disabled. They are very expensive to care for and I greatly needed that child support.

Texas fathers don't have to pay crap. I haven't even been paid a whole months worth since the beginning of the year and Texas does nothing. He has a job as a server so he doesn't report anything. Just got a deposit from the state for $3.24. Texas supports dead beat dads more than they do the mothers who work their butt off for their child.

Texas is full of lazy mothers that just want a check.They have kids with 3-4 different dads they have it made.Add food stamps,medicade,and/or chip as a single mom.Then they use 20%,medical,and childcare as a pay check new car, house,and supporting a dead beat boyfriend.While the hard working dad lives on a couch picks up his kid 3-4 times a week. These judges need to get off their a$$*$ and go after dead beat dads.The way i see it if you have a job a judge slams his gavel instantly child support deducted.No foot work never having to do any actual work. Case close.

my son just found out he has a 15 yr old daughter the mother kept her a secret stating i intimadaited her she thought that i might take the child from her which is ludacris. we had a paternity test done which came back 99.99 percent also she had her daughter in someone elses name because he was with her at the time of birth he also sign the birth certificate but he was killed in a car accident which does not mean anything in texas because 1st she ask for 10,000 which my son does not have so then she ask for 3 years back child support which by law she can which is so unfair because hes not a dead beat dad he did not know he had a daughter.

I went through same situation. I'm the custodial parent and trust me. My lawyer begged me to charge him for arrears which is max 10 years. And I said no, do not charge him for arrears. And I stuck to it and the court did not charge him for arrears. It all comes down to the "custodial" parents decision trust me because when I went to the Child support office they even asked me "how much do you want"... "how much do you want him to pay you" "This is the most you can get who much you want"...

No, it's not fair!!

I understand that a child deserves to be supported but if the mother intintianally withheld the information of this child from a possible father why should he be liable for paying her back? What about the time he missed with his child? Who and how is he going to be "payed back" for that?? I am a mother that collects childsupport, I am also the wife of a husband of a similar situation. It's not fair, he didnt' know, he wasn't running or a dead beat father! They minute he learned of him being a possible father to this child he took action, so why is he being punished financially when the mother purposley with held the information!?! The child has been supported, why not just move forward from then on?

If there is a problem with visitation, there is a visitation hotline number full of lawyers. Just visit the office or call the toll free number. Another thing to, if you are unable to locate the custodial parent, you can contact the toll free number as them for a parental location action. So if the custodial parent refuses to let you see your child, here is some help.

but it really isn't. Just because you didn't know about him, doesn't mean he didn't exist. It doesn't mean that the cost of living and providing for a child was free! She was wrong to keep your child from you, but she did care for him 100% for those 12 years, and now you are just paying her back. Whether or not you knew him, is irrelevant. Nobody likes getting their money taken from them, but it is necessary. There is no way for a judge to look at you and say he looks like he will be a responsible guy, and will pay his support like he is supposed to! Just think about it, and you will see it it the most fair judgment that could be made.

Well I feel your pain, My husband is in a simaler situation, he gave his ex half his tax refund for 3yrs to pay for childsupport when he was in Jail, she in turn told the OAG, that she never received any money so he is behind 10,000 dollers. The judges don't care if you have proof or not it is all about the money!!!! If I were you get a lawyer because they sould have just gone back to the time of the pat. test. Keep your head up!

You must be in Bexar county . Yes Texas child support laws in Texas need overhauling. I would suggest that you take out any 401 K you might have and sell any assets other than your home. Because believe me if they want they can come after all of it. Dont waste any more time. Get everything liquidated. And Live on a cash bases because you are a setting duck. Be their and done that.
