Child Support.....

by Barbara Diaz
(Tampa, Fl)

I was married not just once but twice to the same man. We have 3 children together. In our first divorce I received child support in full at the Alabama guide lines which is $1,200.00, every month all year long and all taxes on all 3 children while we lived in Tampa, Fl. (The children and I, moved after the first divorce to Tampa, Fl as well as we are living here once again.) This time around my former husband pays $900.00 a month for child support on all 3 children and receives all taxes on all 3 children and does not have to pay child support while they are out of school during the summer which is 2 and a half months.

I am currently trying to get the jurisdiction/venue moved from Alabama to Tampa Fl so that I can file to have my child support changed, increased and retro acted back 2 years, also based on my income for those 2 yrs. And to get every other holiday as well. He is fighting it stating that as long as the children have a significant tie to the state that the original state signed the order in and was done in that jurisdiction will not be moved? Is this true ? I heard that after you live in one state for more then 6 months or longer that the juristion/venue can be moved in the best interest of the children.

Which would be to have all cases heard in the same state that the children live in currently and not the state that they once lived in. And to have child support changed when needed and to reflect the cost of living in the state that they are living in and not living in any longer. And is the jurisdiction/venue not about the children and the children only, and not about the parents nor where the juristion stared at ? He has saved over $18,000.00 in not paying child support at the Tampa Fl guide lines, and he has since bought a speed boat and a new car while we are struggling.

I already hired two attorneys in which one was disbarred for having a affair with a client, and the other moved! Please help us !
