Concerned Wife

My husband had a previous relation with a woman before we were ever together and they had a little girl. For 7 years he paid child support without a court order and they never had any problems. In 2007 He lost his job and we fell two months behind. This was enough to really piss off the grandmother ( the mother has no ties with the child) and the grandmother brought my husband to court. He was court ordered to pay 300 dollars a month until the back two months were payed. Once that was cleared he had to pay 290 a month. We had payed that via check withholding for nearly a year no problem.


This year however he got very sick with walking phenomena and he missed to many days of work and was let go.We live in a small town, and we also have a daughter of our own. He had tried to get work with a friend of a friend doing construction for about a week but when it came payday the guy only gave 100 bucks of 400 dollar check! Needless to say we couldn't rely on that kind of income. We tried to collect unemployment but they denied him, the company he worked for said it was voluntary leave even though he was ill! So we got no unemployment, no jobs hiring. He FINALLY got a job about two months ago give or take a week working at a restaurant.

HE GOT SICK AGAIN! He has very bad asthma and the slightest of colds can turn into phenomena. We have no insurance so we could not take him to a doctor so he had to just fight it out. Again he was out to many days. We had called the child support office a week before he got sick to have the necessary papers turned in for the check withholding, by the time the papers were sent they already told him it would be best if he found another place of employment due to his health conditions.

My husband again tried to collect unemployment but was again denied. He called the child support office and told them he was looking for work, the lady was nice said at least you called. My husband then went to an employment agency for work. He landed a factory job but after three days he was let go because he was to big to fit in an area that needed to be cleaned! He was fired for his size! That very same day he went to a restaurant that was hiring and thank god HE GOT THE JOB! He is working there currently. But the papers have already been served to go to court on the 22nd which is MY BIRTHDAY! So my concern is, if we can save up every dime we can to have some money to give them on the court date, and have the papers turned into the job for the check withholding is my husband still at risk for going to jail!

We have a little girl at home, and I currently am collecting unemployment from my job ( its seasons and I go back to work in October if i have my job right now we wouldn't be in this spot!) He just got this job and we are several months behind on rent and worried about our electric. I just can't bare to see my husband go to jail at all let alone on my birthday and still somehow find a way to take care of my daughter and survive on 150 a week on my unemployment. He has never really been in any trouble with child support before and never in any kind of trouble with the law. We are just a family that got a little behind. Total owed is about 900 dollars. We are in Tennessee and they are so strict on fathers here please ease my worries!

you need a lawyer

You need a Lawyer . Not for child support but for all the jobs you have lost due to illness. Check the laws in your state to see what they are . You may have a large law suit on all the jobs you were fired due to illness. Also could be discremation suit on your size. A lot of lawyers will do these suits and will collect when suit is won. Good luck
