My children are both under 14. Thank you for the advice if the judgement; I am calling my case manager today anyway so I will ask.

Is there a judgment taken on the support? As long as you get one before the children turn 23, the money will always be owed. However, it is true that the State will get their arrears first since your kids are emancipated. Regardless of what your ex desires or requests- his opinion doesn't matter. But then once they do, they'll collect for you. Make sure you get a judgment.

BACK CHILD SUPPORT

In the state of North Carolina, arrears child support never goes away no matter how old the children get. One has to actively pursue the arrears though; monthly, quarterly annually or whatever. But it has to be pursued. I applied for child support six months after I gained custody through the county attorney, WELL WORTH THE $25.00 FEE that is deducted once a year. I am currently pursuing back child support from my ex-wife. Child Support Laws are very specific and need to be pursued; pursue it if you are owed back child support. Don't pursue it to be mean; if it is court ordered it is court ordered-pursue it! Make some phone calls to your local CSE Agency or County Attorney. Don't forget, it is not about you or your ex, it is about your children.

Civil Suit

What about a civil suit? I am in the same boat--my ex owes over 15,000, he just remarried, owns a home in someone else's name, works off the books. His new wife also owns a home. The SCU did not enforce or investigate when new information was given to them and now he is "Scott free" or so he thinks. They tell me he has judgements against him for this money but what can we do? No one seems to want to help!

If your children are over the age of 18 there is nothing you can do now. they are adults. if one is under the age of 18, go to your local child support claim office and file a claim. the child will keep receiving child support back pay or the term i like to use, debt, until they are 28 years of age. your ex will be served papers within twenty days of the claim and if he does not respond, the State will start taking money from him, they take from SSI, SSDI, Income Taxes, tons of different incomes, within 40 days.
