Crazy the length of time to process papers!

by Lorrie
(Azle, Tx)

I am a custodial parent. Me and my ex went in in 2004 for a review. Our daughters child support has been the same since 1996 a whole $200 a month. They put him on probation for 10 years because he was over $20,000 behind and added $115 for back pay. In 2006 I went in again because my ex had a really good job. He did not show. The paper work said support would be over $400 + help on ins. +back pay. Total of $601. They could not find him though to serve him!!! He probably answered the door! So because he did not see the paperwork it was tossed out! And he still had the great job and was only paying $72.69 a week towards child support. He was suppose to be checking in once a month yeah like that happened. Violation of probation right there! I put in for a review last year because they said we had to redo the papers. They lost me in the system! So I placed paperwork in again around the first of April...my review is finally this Wednesday! After calling several times asking about it! Oh did I mention my ex quit his $22 an hour job last week. I told him about the review and he said good maybe they will lower my payments!!! Thanks to the slow @#$@# system. He gets away with crap again. He is suppose to have ins on my daughter and does not. I pay around $70 a month thru my husbands work. And my ex does nothing. The system isn't bias against men like some say... it doesn't care about the kids! To heck with custodial and non-custodial. Its the kids who get caught in the middle!

here is the real problem

the system in texas abuses good dads who pay, show up for reviews, and want to see their kids. deadbeats have it made, and greedy custodial parents have it made.

Lori,

I too have problems with the Texas Attorney General's office as a non-custodial parent. Do I agree with women always seeking to benefit from a man's additional income? Absolutely not! There comes a point when the system and the custodial parent attempt to use the kids as puppets to garner more support.

If your ex is only paying $200.00 a month of less; then I could honestly say that's not enough to provide support for even one child. However, there needs to be a line drawn somewhere as to what is enough. The state will tell you the non-custodial parent should pay 20% of net earnings. I may agree with that for people with lower paying jobs, but not when higher salaries are involved. What happens is the custodial parent benefits from any income not used directly in support of the child.

In my situation, I was making a mere $1500.00 a month when my case was filed. Now, I clear $100,000.00 a year now. Because my salary is much higher, my ex wants much more and we are awaiting a court date. If you do the math, she may receive approximately $1200.00 a month plus heath care for one child. So, if you or anyone else can convince me that it takes that much to provide for one child in a small Texas town; I would love to hear it.
