I've had custody of my child since she was 2 years old. I'm a young father and the mother was ordered to pay $200 a month in an out of court agreement that was signed by the judge. Years later she was behind almost 4,5000. She had been using her other child to get income tax back on her,but that child didn't even live with her either full time. Not at one time since then has the state of texas with held from her taxes or forced her to pay. WHY? If the "state" does not file on her from the get go, they won't seek charges. Remember if you paid a lawyer to represent you in court, the state will not help you with your case, you will have to hire a lawyer to get the other parent to pay the child support. Since 2003 i've had my child, the state since then has issueed a warrent for my arrest for non-pay of child support on behalf of the non-custodials behalf for when she had custody of the child, 3 years after she handed over the child and court issued the change in custodialship, and all child support on under my name was paid up when she had custody. Contacting the state I was told " YOU owe it, so pay it, just like every other father has too!" but my lawyer, once again, had to be paid to tell the state of texas what was true and right. never was i arrested for this. The mother of my child still sees her as court ordered, but still as of November 2010, has not paid her child support on time, unless i drag her into court and make the court order her to do so. She was behind around 4,500, my arrest warrent for non-pay of child support was a little 1,500. Why the difference? She also has not worked or tired to support herself or her other 2 childern, her new husband of 2? years, does it.
