In the State of Delaware, a request can be made for the court to review a court order for Delaware child support laws if it has been at least two and a half years since the last order was issued. The child support order will be reviewed and/or modified based on the Delaware Child Support Formula.
The court will not review a child support order sooner than 2 ½ years unless there has been a substantial change in circumstances (for instance, a change in one parent’s employment or a change in the custody of the child).
How Are Child Support Payments Processed?
Child support is collected and disbursed through the Division of Child Support Enforcement. A non-custodial parent can choose to pay his or her child support payments via check, money order, wage attachment, or electronic fund transfers. Child support payments may also be collected using the child support enforcement methods mentioned above.
Once a child support payment is received by the Division of Child Support laws, a check is usually sent to the custodial parent within two business days. If requested, the custodial parent may also receive his or her payments via direct deposit.
How Long Does It Take To Receive Child Support Payments?
In the State of Delaware, the amount of time it will take to establish a support order will depend upon whether or not the Division of Delaware Child Support Laws Enforcement has all of the information it needs to process the claim, and whether or not the non-custodial is currently located in Delaware.
In general, if he or she is in state, the whole process can be completed much quicker than if the non-custodial parent is living in another state. From the date of your initial application, you can expect to wait approximately three months before a child support order is established if the non-custodial parent is in Delaware.
If he or she is in another state, the process may take six months to a year. In addition, if the location of the non-custodial parent is unknown, it will take even more time to locate the individual and process the claim.
