My story is simple I have a divorce decree that means nothing if you are from out of state. my ex-wife was in violation of the court order moved to another state. I had no contact with the kids for 13yrs. all along I'm still forced to pay child support. Even went to my case worker all she could tell me is that was a civil matter and I need to take it up with the courts. While in the mean time she has remarried and bouncing from state to state. Not to mention my kids were being home schooled and I wasn't even notified or even given credit for the 2yrs that they were on the run not to mention my oldest daughter is now two grades behind from this ordeal. I called the state to tell them I should be credited for the two yrs and they tell me it's a civil problem, but yet if I don't pay it's a Texas problem. I feel the court order should be imposed regardless if you are in state or out of state, but I guess because they(texas) is not reaping any rewards from the system. My list of complaints are too long to list and I just wish there were laws out there for people who can't afford to fight the out of state battles that are put before them. To add insult to injury Texas has a 12% interest rate because they know the average parent will not be able to make that 1600 mile flight or drive. So if someone out there that knows something that could help please help a father that misses his kids.Thanx

Hi Tim

The first thing I would suggest is you go to whomever it is in the military and discuss with them what your options are. From what I understand, the military pulls it directly from your pay so i'm not understanding how you are able to pay your ex in different amounts without going through the court.
Secondly, the state of Texas says you must continue to pay until your child(ren) turns 18 or graduates from high school, whichever comes last. Or if they join the military or marry. Your ex must abide by the law in the state in which the divorce was finalized until she petitons the court for a change of venue.
Click on the state information tab and then pick the state in which you were divorced. That should help you. I've been doing a little research myself and these are things I have read on this site. Hope this helps.

Hello,

My name is Tim and I am having some major issues and questions that I cannot seem to find answers to. I am active duty military and have been for 19 years. I was divorced on 15 November 2007 and since that time I have paid child support. Our divorce decree states that both parties will have joint custody of the children (2) so my kids would come live with me for an uncertain period of time the go back to mom's then decide they wanted to come live with me and so on. At any given time with the exception of a few months (4) I have had either of my children depending on which one wants to come live with me since 2007. On January 1, 2007 my youngest daughter come to live with me. At the same time my oldest daughter was engaged and her fiance went off for his Basic Training and Advanced Individual Training (AIT). Since January up until May I continued to pay my ex child support for my youngest daughter because she had no job and from what she said could not get one. Keep in mind she has only worked maybe 4 to 6 months since we have been divorced. Anyway, she took it upon herself to move from Arkansas to Wisconsin where I am stationed. Since being here my 17 year old daughter has been giving her money from what her fiance is making in the Army, my 17 year old daughter dropped out of high school while living with her mother 6 months ago and got her GED. My 17 year old hasn't gotten a job since. Meanwhile my youngest daughter has lived with me up until 2 weeks ago. Before my youngest left two weeks ago I stopped the allotment of $750 a month for child support so in turn my ex did not get any money this month. She is threatening me with going to JAG the military legal office, and whatever else she can think of. I told her since my youngest has choosen to come live with her because she don't want to follow my rules, that I have restarted the allotment for my youngest which is $450 a month. Since my ex chose to move up here to Wisconsin does the child support laws change to Wisconsin for her? And since my oldest daughter is out of school and beinmg supported by her fiance do I still have to pay child support for her? Please help!!! my email address is rakkadoc_95@yahoo.com
