I have been suffering with this issue as well.
I am a disabled veteran as well and I have one child.
I received my service connection in 2006. At the time it was $243.00 a month and my child support payments were $256.00 I offered to give them my check as it was my only source of income so that I could continue to have my drivers license to continue my therapy and seek employment. They denied my request and told me they would garnish my pay check, (although I wondered what check if I am disabled and unemployed), seize my bank account and tax returns. They also told me they have taking away my rights to a passport and drivers license, and that they were going to put me in jail.
Besides the fact that this agency gets matching government dollars for every dollar that it collects. It is in there interest to use all means at their disposal to collect. I also attempted to save the check till I had over $1,000.00 and then made a payment. This would allow me to get my license back, but every time child support suspends your license the fee seems to double? So this process did not work.
In 2010 I received SSDI and my ex wife receives the benefit for my child. She received over 16,000 and receives 600.00 a month. Child support did not count this towards my payments and states that this is not considered child support. This is universal policy among all states that I am aware of.
I am currently filing a motion in court with regards to this Matter and asking the court to force child support to count this toward my past and current obligations and requesting an immediate retroactive reinstatement of my drivers license. Since each reinstatement adds an increasing financial burden. I don't think the retroactive will go thru, but I am confident in the rest.
4 out of 5 District court of appeals in Florida have already ruled in this matter on behalf of the disabled in stating that SSDI benefits paid to the child on behalf of the father must be counted. Although the agency refuses to make this standard policy. Instead forcing the disabled citizen (who is likely ignorant of the court system) to defend themselves. Defending themselves because if you can't afford your child support payment how can you afford an attorney?
I am interested in filling a lawsuit against the government in regards to this issue on behalf of the disabled and disabled veterans and how they are treated by this agency. I am not a lawyer. I am a disabled veteran. I will not stand by and allow my country to treat me and those like me in such a manner that would deny us the opportunity to Life, Liberty, and the pursuit of happiness. I cannot do this alone. I need to show that this is not an isolated case, but the standard treatment shown to those who are disabled. i got out sevice connected w...disability..wife divorced me 2 years later.i called pa youth services and told them she wasnt fit.she married a guy who was a severe alcoholic.i knew at the time support wasnt going to the kids.i worked a TOTAL of 8 and a half years after getting out of gulf war time period vet.i tried to work to do the best i could to support the kids and worked more off than on.i was unable to work in 2003 because my conditions got much worse.in 1999 i was told my kids were being taken away from my ex wife due to conditions.i called and requested the state of pa to notify me when the hearing was...6 months past and no notification.i have seen my children about ten times over their childhood due to denial of being able to see them.when i did work..both the state of indiana where i was living and the state of pa garnished my check to a point i paid 14 years of support in an 8 and a half year period.i know this because my kids are 18 now and they claim i owe 4 years back support.when i was placed on ssdi in 2003 a judge in illinois ruled(where i was living) that my ssdi the kids recieved counted as child support and this was 7 years ago..i moved back to indiana and had the nightmare start all over again.even though the past 7 years the kids have been getting 800 a month of ssdi i worked for..the state of pa claims it doesnt count.i have now overpaid if they followed the judges ruling but they dont.so the custodial parents now get the social security from me for the kids,,,garnishment from my ssdi on top of it.support from my ex wife.i hired an attorney in indiana..paid him 2000 just for him to tell me he couldnt practice in the state of pa.i cant get a passport....and i call pa lawyers to try to resolve the issue and get no return phone calls(cause i dont reside there) what beautiful laws the u.s puts in place to totally ruin peoples lives/ive just got to the point to let them do whatever their going to do..they already have for the past 18 years and the kicker is...you have to fight the government for your benefits for years and years and years(18 for me) go near homeless on several occasions...and regardless the government wants their money over their outdated support laws but they dont care if you have to fight forever to get your own benefits...since the government wont make this federal so fathers can deal with ex"s state to state...its impossible to ever resolve any issues

I am a none custodial parent.Two years ago I sufferd major heart problems and still do.The time that I spent in hospitals dealing with this has put me behind in my support.I like you and your husband have spoken with child support recovery and judges.I have also provided them with doctor notes and letters that I should not be working.I have filed for ssi benefit but have not recieved an answer from this either.What I find really amazing is that I presented medical evidence and letters to child support and the judge.Well I got the same answer as you they don't care.They don't care what they do to us and they have thelaws on the books so that we have no defence againt them.If you look into the history of childsupport recovery.You will find it was invented to stop parents from abusing the state wellfair system.But they make no effort in stoping them from abusing us.They don't don't care if we have food to eat or cloths to wear.But we better have the childsupport money.I know this dosn't help but they are millions of us that have the same problems so we feel your pain.I just wonder if the people who push this so much will think it is such a great system when they have watch there kids go thrue it.I will tell you this I set down every day and send letter to media and goverment office complaining.I guess if the millions of us being abuse by child support would do this.Maybe we might change things.Good luck to you and your husband.And I hope things work out and get better.
