Father with custody

by John
(Colorado)

More of a question. How is it that even though there is a higher percentage rate of single father's in the country that we can not get any kind of assistance from the state in pursuing child support payments from the mother. If the tables were turned the state would be after us no questions asked. I am in a situation where I can not get the CSE to take my case. Even during the divorce hearing I was told by the judge I am trying to rip her off because I asked for $175.00 a month in payment. My son's biological mother has not done nothing for her son. Why is this situation one sided. Shouldn't a DEAD BEAT MOM be sought after as well. After isn't it what's best for the child or is a bunch vengeful women who only see one side of the story and does not want to hear anything else because of personal feelings? I had a case worker tell me that she can make my life miserabel if she wanted to. Are these the type of people we want having authority over OUR ON CHILDREN? I think not!!!!!!!! Father's we have to start engaging with our city council men and women and take a stand for Father's Rights. We are in the 21st century and I know A LOT more single father's who are trying to provide for their child including myself and only get looked over by the CSE because we are men. REAL MEN TRYING TO GET THE DEAD BEAT MOM'S TO ASSIST WITH TAKING CARE OF THEIR KIDS the same way they have been doing for years. State politicians need to be notified of this discremination. We FATHER'S HAVE RIGHTS TOO!!!
Sincerly, a single father with a dead beat mom issues. Yes my baby's momma!!!!!!!!

I am with you.

I too am a single father who has custody of my son. Since 2002 his mom hasn't paid child support. She is getting away with it. On the other hand my first wife took my visitation rights to see my 2 older sons away from me when she moved them out of the state of Florida with out a court order in 1986. I refused to pay any more child support during that time. Yes I shouldn't have done that but I did. I was wrong doing so. I was young and stupid. I contacted the courts about this and just told me that I would have to hire a lawyer and sue her for it. The courts didn't do anything for me. When my 2nd oldest son was kicked out of his mothers home when he was 15 years old I was order to continue to pay her support. She hasn't supported him since then. NC is still ordering me to pay her support even though he is 29 years old now. There are discrepancies in the order namely her last name. She hasn't carried that last name for at least 8 years which means she is endorsing
checks with her previous marital last name. That she be illegal and she is getting away with that. I feel you and hope that someday something will be done for us fathers.

Dear PJ

I am responding to PJ. It's not just FATHERS. It's mothers and YOUNG ADULTS that are being victimized by TEXAS law.

Texas is one of those backwards states that does not do "means testing." And, from what I understand, it REQUIRES the non-custodial parent to pay child support no matter what the financial situation. Even when the custodial parent is wealthy and the non-custodial parent is poor, the non-custodial must pay child support or risk jail time. THIS IS CRAZY and, in my opinion, borders on a civil rights issue.

In my case, my son's very wealthy father is collecting child support from me (barely earning min. wage) even though he verbally agreed (to me and my son - which was, I believe, inappropriate) to NEVER ask for child support as a condition of my releasing physical custody to him when my son was age 11 and wanted to try living with his dad. In this case, the wealthy dad moved my son (against his will and without my consent as a parent that shares legal custody) to TEXAS from New Mexico specifically because the laws would be more favorable.

I am confident that someday I will be in a much better financial state. But at the moment, I am barely getting by (a full time student, trying to set a good example to my son by earning two bachelors degrees, and I work full time as a freelance graphic and web designer).

Currently, I am in arrears and at risk of serving jail time. My son and I are afraid and, even more, angry by the child support laws of Texas.

you are right
by: pj

Yes you are so right. All men in this country need to get their state repersentive for their zip code, Look it up on the internet if you dont know. Be a voter, my advice is be independent so you can use both sides to your advantage. Contact them demand new laws changed on the subject . Demand that men get a equal break. And to stop jailing when they have no job. That is counter productive. Who is getting supported then if the man is in jail. Demand that the mothers income and persent sitution be concidered. Demand that it both situtions be monitored. Write and email daily to the reps. Make them tired of hearing from you till they listen. Ingage all men with child support to do the same.
Then you should report that case worker. And get the best lawyer you can .Preferable a woman Lawyer they are more aggresive . What I have told you is what I do now here in Texas. I am trying to get the laws changed. But we need men all over the country to do the same. Good luck
