Father

by Daddy
(Oregon)

I have a 2-year-old and her mother and I have joint custody. I have a job and she works under the table at a bar (shes 19) she has my daughter in medicaid through the state and refuses to allow me to put her on my insurance through my work. When I started having the state garnish me for my support (im not behind at all) they also demanded that I put her on my insurance so I did but my support hasn't gone down yet?? what should I do? I get my daughter 4 out of the 7 days a week. shouldn't my support go down??

Take it back to court
by: Anonymous

I would take it back to court, for both a modification of Child Support, as well as primary custodial parent. Most states will only allow you to file a modification if the income change is more then a certain percentage, or it has been so long since the last modification (check with your local child support office). But with what you are saying about you having the majority of the parenting time, then you should fight to get primary custody. If you do, make sure you have all your ducks in a row. Document every thing, show proof that the child is with you more often. What ever you can show on paper will help you case even more. But without a current court order (and your support being current), child support enforcement will not change your support order to reflect the difference with the insurance.
