I have faithfully paid my child support obligation for my daughter for the past 10 years. My income was always higher than my ex-wife's and Support was always calculated according to the child support guidelines based upon both of our incomes. Until...I became involuntarily unemployed 14 months ago and the same month, my ex got a job that more than doubled her income. Now she's bringing home the bacon and I'm struggling with my wife and two other daughters drawing unemployment; which is only about 55% of my original income. I petitioned the court to modify my child support and the judge has continually refused to recalculate it based upon our incomes since her income has been higher than mine. I had also adopted my wife's daughter and we had one biologically. Well, the judge also refuses to recognize the daughter I adopted as any qualifying factor for modification (which would increase the reduction in my support obligation). Oh, did I forget to mention that my ex-father-in-law is also a judge in the same county as my family court judge? I have asked this to be explained to me and requested that the guidelines be followed according to the current incomes at every review. Do you think the judge gives me any direct answers or follows those guidelines now that his fellow judge's daughter (my ex) makes more than me and would have a reduction in child support that she receives? NO WAY!!! When my ex refused me visitation on numerous times with my daughter, do you think the judge found her in contempt of court after I filed the complaint? OF COURSE HE DIDN'T!!! I finally contacted my governor's office and informed them of the situation. If they don't resolve it, my next step is to hand over all of my documentation to the local news media and let them all be revealed for their unethical actions and "good old boy" politics!
