Frustrated Non-Custodial Dad

by L. Sontana
(New York)

I live in New York State and have paid child support faithfully & on time for 1 1/2 years. My former wife is vindictive because I would not give her the child support check one day early this week (she demanded it last minute). She has called her lawyer and is taking me to court to have my wages garnished.

Does anyone out there know NYS criteria for garnishing wages for child support? Is it just her word against mine? I can provide a copy of my cancelled checks to see when she deposited my checks, but if she didn't deposit some right away and claim they were late, does she have any ground to stand on?

Help
Thanks
