In July of 2008 my son was made the custodial parent of his 2 children and his soon to be ex wife was to have her check garnished and was to pay 25% of her net income and was to provide medical health coverage for the children. Twenty-two months later he has yet to receive any child support as well as health insurance coverage. He has provided private health insurance for them as his employer does not provide coverage for employees.
She quit her job one week after the original order and has not provided for the children in any way. She sees the children but has not provided for school supplies, help with lunches, clothing or any incidentals. My son has had to leave work when she didn't pick them up from school, thus resulting in loss of income for him.
He has had to borrow money from us twice to take her back to court and since January of this year his case has been pushed back either because the court did not serve her with papers when they were supposed to. He contacted his attorney as the website for the county showed that the papers were not served and his attorney did not follow up. The attorney got his money but our son has nothing for his children and we are out more attorney fees.
The Texas Attorney General is a joke. My son filed in September of 2009 and as of May 2010 he has not heard anything except that they have his case. He went back to his attorney to hopefully speed up the process but of course it hasn't worked out for him. It is ridiculous that we pay the state to do the job they are supposed to be doing and are not.
It is very difficult for any single parent to work full time and be a full time parent. The courts of Texas and the State of Texas really do not understand this.
It angers me that the Attorney General's website actually refers to fathers that do not pay child support when it should state a parent who does not pay.
We truly believe that she will get away with not paying what she owes. The written laws are only words. If the situation were reversed, my son would be in jail. There are no one watching to see if parents are not paying their obligations even though payments are supposed to go through the state before they are dispersed to the children. I am sure there is money to be made for someone in government before it ever helps the child. Texas is really a disgusting state.
