I need any advice anyone can give me!

My husband recently started a job were he makes very good pay. He gets checks for daily pay and salary. The daily pay is not a guaranteed amount each month, it is based off of how many days a month he works. Salary is guaranteed. Well we received a letter in mail for a hearing....more or less he is going to have to pay more child support. Which i am all for, but......we keep the child more than the custodial parent does. Out of 365 days we have the child at least 250 days. Five years ago the court decided we were to have him every other weekend....well she comes up with some excuse for him to come stay with us. What can we do to keep her from getting more support? How can we prove that we have the child more than the mother does? Will the support be based off of just his salary, or will the daily rate be included in this? We don't want things to get messy, scared she will cut it back to every other weekend. The child is six and does NOT like it when he has to go to his moms house....We just don't know what to do. I can not imagine if have to pay her more money!

The State of Oklahoma simply does not care. You need to document everything and file for full custody. They will continue to raise the child support until it is impossible for you to live. That is what happened to my husband.

For starters, take the child to a child psychologist and get a written statement from the psychologist on their letterhead that they have been counseling with the child and what the child says about NOT wanting to be at the mother's home, the lasting damage visitation inflicts on the child and be willing to testify if need be in court on behalf of the child. Make sure this visit to a psychologist is paid for and get a receipt in hand. Then find a family law attorney and fight for full custody. The letter from the psychologist is/or should be the key.

I recommend hiring a lawyer and consider petitioning the court for custody. Fight for full custody and have the mother get visitations. Or you may be able to get shared custody with equal time with you and your husband and no child support from either parent being paid. Something to consider, but definitely get a lawyer and get advise.
