Interstate Enforcement of Child Support
My daughter's father lives in AL, and we reside in NC. We have had an interstate action between the 2 states for over 4 years now, and my daughter's father is almost $8,000.00 in arrearages. He is court ordered to pay $250.00 per month, which doesn't even come close to meeting the amount that it takes to raise a child these days. He is also ordered to provide medical coverage, which he has never done.
Though my caseworker in NC continues to ask for enforcement from the state of AL, nothing is done to my daughter's father to enforce the child support order. I was told that if I retained a lawyer, that they could have him in court within 30 days, but DSS says that they don't take people to court just because they are behind on their child support. AL is an administrative state, and they try to enforce child support by other means than jail time. But, I have also been told by the DHHR caseworker in AL, that when all other methods have been exhausted, that they will summon them to court...in 4 years, this has never been done. My daughter's father continues to walk around a free man, while not owning up to his responsibilities as a parent.
I have contacted everyone that I can think of, even Gov. Ripley and the federal office of child support enforcement, and still, there has been no enforcement on the case. What gives...if a custodial parent barely has enough to make ends meet, how in the world can they afford a private attorney to get the deadbeat into court? I thought that DSS/DHHR was there to help custodial parents collect child support for their children...guess I was wrong, as nothing has been done to my daughter's father in the 9 years she has been on this earth as far as enforcement goes.
Best of luck to all of you trying to get interstate enforcement of your child support orders.
