Is this the way the system works

I applied for child support in Oct 2004, 4 years ago to date and in this time the dad lied and stated he was paying in the town he was in and my case got moved. It sat there for 2 years and they found where he was ordered to pay for 12 months and never did! I had to go out the expense of retaining a lawyer to move my case back to the place I originally applied. I asked for help because he has been absent for years and needs to realize he helped make these babies & needs to help take care of them. I am now in a position I may need to hire another lawyer due to my full time in RN school. I had no idea the system works to help the dead beat dads and not the children. Applying for child support in Texas will cost you more than you will ever see! This is ridiculous that this system states it's for the children but does everything to work against them and I'm sorry I ever applied!! I'd rather drop everything and tell him to stay away from us as he never called or visited until this past May, but they say it has to ride until it's all done. What a crock... some child support system we have... as soon as I get my nursing license I'm gone from this supposed great state!!

The system works, but it isn't fair

Let me tell you this; I'm not sure what local branch you are working with, but something is definately wrong if your story is as you say. First off, if there's an existing order to pay child support (I'll assume so), then that order stands. I'm not sure how he got the case moved because it should stay in the county where it was filed unless YOU move and have it transfered.

The state tracks all money paid in Child Support through the San Antonio Child Support Disbursement Unit. If he isn't paying it, then you need to open up a case with your local branch. As long as he shows up on a payroll (regardless of state), they will automatically tap into his wages.

If you are not happy with the agency, then go to their website under the Child Support Division and click on complaints. These complaints are handled by the Office of the Omsbudsman. They will investigate and see if the agency is operating within the law. But, it's not a fast process because they handle so many.

As a non custodial parent myself, I get pissed at fathers who are considered dead beats because we all get treated in the same fashion. Trust me, the agency is one-sided and leans towards the custodial parent. They do absolutely nothing for us; including enforcement of visitation.

Lastly, if you have to hire an attorney and can prove the other party is not following the existing order, then your attorney can request that you get reimbursed for expenses. From people I know who had similar situations, that's exactly what the judge ordered.
