IT'S NOT FAIR!

by Tom
(KY)

When I returned stateside after being in Desert Shield/Desert Storm my wife and 2 girls could not be found. After months and months of searching I found them in TN, living with my wife's new boyfriend. My wife didn't want to be married to me any longer or have the kids either, so I gathered up the kids, out stuff, etc and moved back home to KY.

Once I returned to KY, I started the divorce process which took forever; in the meantime I meet someone. Not once in the year that I returned to KY did she call or visit the kids. She mailed me their birth certificates and that was that. To make a long story short, the divorce became final, I got the kids and she was to pay $25 a month child support for both children. Two years later, I've married my new wife, had a baby, and finally child support services sent her a notice in the amount of $925.75. When she received that notice she got her a free lawyer and sued me for sole custody of my kids. She didn't realize she had signed divorce papers and all that.

We had to go to mediation, my kids had to have supervised visitation with this woman they didn't even know. The court system was about to screw me over when finally I got before a judge that could see the $$ signs on the wall. The money signs my ex was seeing.

He gave her supervised visits and changed the $25 for both kids to $25 per kid. Did she ever request to see the kids? Nope! Did we ever see ANY money? Nope! We're glad that she has gone away and we don't have to deal with her for the past 17 years!

IF it had been the other way around and I was pay; I would have been made to pay a lot more, put in jail, GOD only knows what they would have done to me. The court system is FLAWED! It worked out for me but there are so many others that it doesn't work out for and IT'S NOT FAIR!!!

Not just men that are being abused - young adults in Lubbock Texas with no rights
by: Anonymous

It's not just men that are abused by the system - in Texas, it's the parent with the smaller bank account and young adults that are being abused. My son's wealthy father, who I shared joint legal custody with, decided one day (24 months ago) to take our son to Texas as a punishment for grades that dropped below a 3.25 GPA. Instead of reporting a kidnapping, I went the route of hiring an attorney and taking him to court on behalf of my son who was, at the time, 15 years old. I had to hire a New Mexico attorney and a Lubbock, TX attorney that was licensed to practice in New Mexico (where we had all been living).

Long story short, my son filed a Preference of Child to request that he be returned to my custody in New Mexico -- it was ignored -- he was ignorned -- I was ignored. The wealthy father, who punishes his young adult son by forceably moving him to Lubbock Texas was awarded physical custody. Judge Medina said, in so many words, that he believed a young man needs the firm hand of a father. He did talk with my son, but it was (as I understand) a speech about how his strick father is the reason he is a successful judge -- finally, he encouraged my son to make Lubbock his home, make some new friends, join an MMA club/gym (stupid advise for a young man with a lot of anger towards an angry father that wants nothing more than total control of his young adult son).

You are so right, Its not fair
by: Anonymous

You are so right. You are very blessed that it went your way. Because it does not go that way for most men . They get abused by the system. The word flawed for the system is way to mild . The system where ever you are is so broken and the judges in childsupport and the AG are just as bad. Thank God you were not in Texas or Bexar co. you would not have had a chance. Texas childsupport is unbelievable abusive to men. Good luck buddy and to your children.
