Love the Texas Attorney General!!! (Sarcasm Intended)

(Louisiana. GEAUX TIGERS!!!)

My ex and I divorced in 2005 in Louisiana where she remained until relocating to Austin in Summer 2006 to persue a Ph.D.. I allowed the relocation of my children at that time, fully foreseeing potential problems. Nearly all of which have come to pass...including one I did not foresee. We discussed in court several times no income assignments or garnishments would be requested or made so long as I stayed current.

On April 23, 2010 I received notification from the AG they were notifying my employer to garnish my wages for $14726 in unpaid child support. I'm surprised I didn't have a stroke right there. I called, very upset, and ended up getting the dates they wanted. Called my bank and had proof of payments to them on April 30. I also notified them of the need to amend the notice before payroll ran on May 3. Of course they didn't. Then, the next week I get an amended order for the change to the summer obligation...only problem is it will affect my last check in May...the order is only for June and July...opening me up to contempt. Then they say I can pay the SDU the difference. Well, they never offered me the opportunity to pay the SDU directly BEFORE issuing an order that clearly didn't need to be made. I have not missed a payment since 2005. Now, I've had to replace one...as the ex had a penchant for holding 4-5 and sending them all through at once. But I've never been late...except once when I was out of town. And it was only 1 or 2 days.

I had been paying by bank draft. And, after she misplaced a check in February, switched to wire transfers to her account. How much easier could it be for the State Of Texas to leave me alone and let me pay her directly at no cost to them as I have been doing for 5 years? I've been told Texas requires garnishments for payment...that's all fine and good. But, they are enforcing a Louisiana case which does not. And, Louisiana maintained jurisdiction in the order.

I will be calling back to them every day to rattle a cage. Like today was calling them incompetent for issuing their order to my employer too quickly. Tomorrow, I'll come up with something else. In a week or two...well, I'll check back in and let you know what I told them. They might be reading this.

As of this morning an enjunction has been ordered against the State of Texas Office of the Attorney General instructing them Louisiana's 37th Judicial District Court has, and maintains, Continuing Judicial Authority of this matter. Texas will not be able to issue any orders related to my matter. If they issue any orders, the State of Louisiana Division of Administration has been enjoined from honoring any writs from Texas.

The attorney for the Office of General Counsel representing DOA said I was the first employee who ever filed things correctly and was able to stop a garnishment.

IT CAN BE DONE!!!

And to Susie, in the Austin call center who asked, "Do you know ANYTHING about child support law?" You might consider I knew more than I let on when I said..."I know a little."

I can't even believe you just said all of that CRAP! I am a woman, have been a single mother, and now am happily married again....AND I ABSOLUTELY AGREE WITH EVERY WORD ALL OF THOSE MEN SAID! Men have stepped up to the plate over the last decade and from what I see, there are more "deadbeat" moms than dads! The men are always getting screwed by women like you!! You get off on screwing them over. Go get a job and support yourself and stop expecting the men to do it just because they had poor judgment and created children with you! Their obligation is to the children not the mothers!

Good luck to all men out their in Texas and else where . It is a mess and unfair system but untill things change . Just batten down the hatches. Live on a cash basis and get everything out of your name. Dont put it in your present wifes name but someone you can trust. Or Dont own anything. Best option.

Spoke with someone in the office today. NOT the call center...I'm amazed! They have all my proof but can't remove arrears unless the ex agrees the funds were for child support. They got her on the phone and she "remembers" some payments. She asked the AG's office to send the printout I'd sent them and the AG asked permission to do so. Heck yeah! Then I was told that what was probably going to happen was that once I am shown as current they will contact Louisiana Child Support and turn the case over to them. After all, I'm still here and it's a Louisiana case, no sense making anyone mad. She actually said that! My response was, "Folks I've spoken with in the last month will tell you...to late."

The judge has reviewed my motion for form and content. It's currently being cleaned up and will be filed with the court by Friday. I'll give you guys all the details once it's signed and the orders are sent out to their respective recipients. I will tell you now, the ex is being ruled in for contempt. She signed documents alleging I was in arrears when this was CLEARLY not the case. That, my friends, is fraud.

well I paid the courts through the court office even before my case was settled and a year and they garnished my wages, accussed me of owing 8,000 in arrears I had to go to court in order for dept a t to talk to dept b to prove my innocence lost time off work employer had to be notified the ex denied it all and the judge response was oh it's okay I understand it's hard to rememeber 550 a month for two years which she recieved on time from day one and I'm the criminal thanks judge just another dead beat dad right?

I was not required to pay through any "system". As a matter of fact, it was discussed in court and excluded as a requirement. She moved to Texas, met with OAG at some point and lied, not verifying I was current. She also continued accepting direct payments after signing documents assuring she wouldn't. I think both Texas and she have bigger problems than they each know.

When you mention jurisdictional issues, rest assured they are about to become a REAL issue for the Texas AG.

By what you wrote. It sounds like you have been paying her and not through the system. That will kill you. Please keep all check receipts and get a very good Lawyer and go to court get it verfied that you have paid . And then pay through the system. Believe me you will live to regret it if you dont. Do not trust the EX on any of this . Good luck

I am glad that u are taking a stand and fighting for your rights, I am doing research into the whole child support laws across the U.S. I have come in contact with many different cases and for the most part they all lead to jurisdictional issues.
I have a close personal case going on right now and I see there is lack of communication between State CSE Agency and the courts along with for my situation tribal jurisdiction.
No one is communicating as to when the hearing was and what was stated by the judge for payments that were agreed upon and other things that were made as part of the judgment. I feel that lack of responsibility on the State CSE Agency is the reason that the "non-custodial parent is treated like a criminal, they have dropped the ball and it's time to put a stop to it all.

Aww, poor men left out in the cold. The laws wouldn't be so strict if men had lived up to their obligations instead of running from them!! Listening to your complaining and boo hoo-ing makes me want to PUKE! To hear you men tell it you're nothing but victims, but PLEASE SPARE ME your sob stories because your BS is completely LOST on me. Not buying for one minute that all of you have just been CHEATED so BADLY... whah, whah, whaaaah!

Man up, deal with the law and move on! It's there for a reason - so cheapskate deadbeat dads don't hide from their obligations. When I hear things like move all your money, live off cash, keep your possessions in your 'new' wife's name - CAN YOU NOT HEAR WHAT A LAME ASS YOU SOUND LIKE??? PUKE on you, puke on your little scheme to get out of paying to raise your child! I hope you get yours someday, dude, and you spend a fiery eternity where you BELONG!! Just a disgusting excuse for a father...
