My ex and I divorced in 2005 in Louisiana where she remained until relocating to Austin in Summer 2006 to persue a Ph.D.. I allowed the relocation of my children at that time, fully foreseeing potential problems. Nearly all of which have come to pass...including one I did not foresee. We discussed in court several times no income assignments or garnishments would be requested or made so long as I stayed current.
On April 23, 2010 I received notification from the AG they were notifying my employer to garnish my wages for $14726 in unpaid child support. I'm surprised I didn't have a stroke right there. I called, very upset, and ended up getting the dates they wanted. Called my bank and had proof of payments to them on April 30. I also notified them of the need to amend the notice before payroll ran on May 3. Of course they didn't. Then, the next week I get an amended order for the change to the summer obligation...only problem is it will affect my last check in May...the order is only for June and July...opening me up to contempt. Then they say I can pay the SDU the difference. Well, they never offered me the opportunity to pay the SDU directly BEFORE issuing an order that clearly didn't need to be made. I have not missed a payment since 2005. Now, I've had to replace one...as the ex had a penchant for holding 4-5 and sending them all through at once. But I've never been late...except once when I was out of town. And it was only 1 or 2 days.
I had been paying by bank draft. And, after she misplaced a check in February, switched to wire transfers to her account. How much easier could it be for the State Of Texas to leave me alone and let me pay her directly at no cost to them as I have been doing for 5 years? I've been told Texas requires garnishments for payment...that's all fine and good. But, they are enforcing a Louisiana case which does not. And, Louisiana maintained jurisdiction in the order.
I will be calling back to them every day to rattle a cage. Like today was calling them incompetent for issuing their order to my employer too quickly. Tomorrow, I'll come up with something else. In a week or two...well, I'll check back in and let you know what I told them. They might be reading this.
