We met in high school and had been together ever since. We never married and now here it is 10 years later and after a year of horrors she has left me. At this point she parties constantly and admits to being addicted to pain killers. I keep the kids most of the time but she threatens to take them from me if I don't give her money every week. I went to lawyer -- he said since we were never married I had very few rights. He said I would have to first get blood tests on all three ($1,500) then pay his fees (another $1,000 plus). I can't afford this -- I was recently laid off from my job and draw an unemployment check. I also suspect she is drawing a welfare type check on the girls and Child Support Enforcement may be knocking at my door anytime. Is there anything I can do?

What you can do is beat her to the punch. Open a case with child protective services and see if they will grant you temporary custody based on her drug addition. Show that you have maintained custody of the kids most of the time. If she does this first, you are screwed. A DNA willnot matter if the court can show that you have an "established relationship" with the kids. Some states have a statute of limitations on DNA testing. For instance, if you believe the kids are not yours and wait more than four years (in Texas) to have them tested.....THEY ARE YOURS FOREVER. The sad thing in all of this is that these women are never held accountable for the people they sleep with. You my friend (like many others) will be forced to pay the price. The last thing any state wants women to do is get welfare. To avoid them from doing so, they go after the guys in the form of child support.

FIRST OF ALL, IF YOU THINK SHE IS GETTING A CHECK FROM WELFARE. REPORT HER! YES YOU NEED TO PROVE SHE IS OUT ALL THE TIME AND TAKE PICTURES. BOTTOM LINE FOLLOW HER. IF SHE IS UNFIT PROVE IT IF SHE TAKES YOU TO COURT. YOU ARE READY AND TRUST ME WHEN I SAY THIS NEVER TELL ANYONE THAT YOU ARE TRYING TO PROVE HER UNFIT. YES YOU NEED TO GET A BLOOD TEST TO PROVE THAT THESE CHILDREN ARE YOURS. BUT YOU MIGHT WANT TO CHECK THE STATE LAWS ABOUT IF YOUR NAME IS ON THE BIRTH CERTIFIATE YOU ARE THERE FATHER. IF SHE SAID ANYTHING ELSE THE COURT WILL ORDER A BLOOD TEST. GOOD LUCK I HOPE I HELPED YOU.
