Non Custodial Father Released From Prison

My son's father owes at least 50,000 in arrears and hasn't paid since 2001. Once I would find out where my son's father was working and call the AG's office by the time they would do whatever paperwork needed he would quit that job. Anyways he (father) ended up going to prison in 2003 for an assault charge and was released on 6/6/08. When I called to notify the AG's office they informed me that my case had been closed. When questioned why they told me that anytime the non custodial parent is in prison the cases get closed. That is new and absurd to me. Has anyone dealt with this or heard of this happening before? My son's father has pretty much gotten away with not paying support from 2001-2003 because he went to prison and the AG's office didn't act on it and now I have to go through the whole application process again.

Correction to my previous comment and a big THANK YOU to my ex-wife!!!

On the comment I made back on May 5th? Well, I need to correct something-- It isn't $800.00/month it is $860.00/month. I also need to mention that both my sons were very much planned for and wanted. After my second son was born back in 1997, in 1999 I had a vasectomy because my wife and I decided we didn't want any more kids---I had a vasectomy and what did she do? She shut me off!!! Yes, I developed some seroius resentments because I thought "Why the hell did I have that proceedure done if I'm not having sex any way? What the hell was the point?" Don't think I wasn't angry about that!!! Now that I'm divorced from her and I know, at 45, I never want any more children, I am having the time of my life with my girlfriend(who has 4 children of her own from her past marriage and does NOT want any more)!! Instead of being resentful to my ex for convincing me to get the vasectomy, I am so thankful that I had the proceedure done BECAUSE, my girlfriend and I have lots and lots and lots of awesome, totally intense, WORRY FREE SEX!!!!! Yeehaa!!! THANK YOU EX WIFE!!! THANK YOU!!!

Dead beat dad's deserve jail, but the mother's who put good father's in jail are the true dead beats!!!!

You and your child managed to get by for the past 12years on your income...why take a father to court over back support because you are money hungry and bitter...If you want any money, you have to allow the father to live...try to take him for all he has and put him in jail so he can't make a dime, and guess what...you wont see a dime! The system is messed up! dead beat dads do deserve jail.......but the system puts good fathers in jail because they can't afford to pay support and live off of what is left!!!!! When the mother is the one who cheated and filed for divorce in the first place!!!!! There is just too much to even get into it!

How the Hell is This Fair? Someone Tell Me Please

I live in Maine. I have been divorced a year now after a 17 year marriage. She had an affair on me. I had very smooth divorce though. We agreed on everything and didn't even require mediation. I got the house along with the mortgage and she moved in with her parents. My 13yr old son moved in with my ex and my 17yr old son stayed with me. because I make 47K as a computer tech and my ex makes 17k as an ed-tech3 for a local grammar school I had to pay $430.00/month to her for child support for my 13yr old(which I have never missed a payment and have completely automated through my employer do I don't have to mess with it). My 17yr old didn't like me being a dad by trying to get him off his lazy butt and get a job to help with the things he wants like... driver's ed. and stuff like that. He "jumped ship" and moved in with his mother and her (after only 6 months of being divorced--what a skank)new, very manipulative, narcissistic husband. She hit me up for more child support. I just went to court 5/5/11 and now I have to pay a total of $800.00 a month to her!!! Because my 17yr old child decided "he" wants to live with her, I have to pay... even thought this is due in part to unscrupulous behavior on her part. Someone tell me how the f#ck is that fair?!?! --- My skank ex-wife isn't even married to the guy she had the affair on me with by the way-- This is yet another guy!!

Hell,

I pay $1200.00 a month for one kid because of my current salary. Think that's fair too? Tell me how you money grabbing would spend that kind of money every month on one kid! Does it mean that it can be used to pay rent, utilities, groceries, and a car payment for everyone else in the house? What portion of expenses is the custodial parent obligated to pay out of her pocket? Let me guess, she gets a free ride because of the money she receives from me. Nothing more than legalized prostitution! Men are paying now for sex they had before.

Well Let Me Tell You!

Most prisons have work programs there where they can do certain jobs and earn money so that way when they have income like that, they can pay. The prison will be notified by the OAG and they will take his money but maybe $10 and send the rest to the AG for Child Support. It takes a little bit of time for the Paperwork but it happens.

My ex owes over $70,000 in back support. I have been going through the OAG for years. I have yet to receive anything since 2002.He has been on probation several times. I was told it was a violation of probation to violate a court ordered child support. The probation officer seems to think other wise. Then he was arrested and sent to prison for several DUI I reported where he was only to be told my case is being closed. He was released on Aug 2 my case was closed on Aug 20. I don't think the Texas OAG even knows what they are doing!

I don't know what state you live in but I live in Mississippi and my ex has been in and out of jail for the better part of the 12 years we have been divorced and they have not closed my case. My ex is so stupid that he thought because he went to jail that he didn't have to pay...I was like "Oh Yeah, I forgot because YOU went to jail YOUR kids stopped living"??!! I was like wtf? I mean come on, can he really be that stupid? The state told him the same thing...he still has to pay...NOT THAT I'VE SEEN A DIME the whole 12 years that we have been divorced! The state is REALLY bad about forcing the child support issue, but I can't afford a lawyer so I am stuck with them! Sure hope they help soon! Did you also know that you can go for back child support up until the age your child turns 25...you have up to 7 years and your kids have even longer...the children can sue for back child support also! Nice to know!

The ponit is that he was not meeting his obligations prior to being incarcerated. Prior to being incarcerated, he told me "I would rather go to jail then pay child support". Another point is with the state closing the case if he has a job (part of parole terms)it would take months to process the the case again and by the time that is done he probably will have lost his job. Like he had in the past. This man has NEVER supported his son (14 years old). Explain to me how an able bodied non incarcerated man would not want to support his child but yet make sure he has the most exsquisite cars and clothes for himself. You need to get real. To be honest I never expected him to pay nor do I need his money but because parents like yourself and him make idoitic comments(do you know what paying child support is going to do to me) to a parent that has been raising/supporting THEIR child by themselves they force the custodial parent to pursue help from the OAG. How real is that for you?
