Non Custodial Father Released From Prison

My son's father owes at least 50,000 in arrears and hasn't paid since 2001. Once I would find out where my son's father was working and call the AG's office by the time they would do whatever paperwork needed he would quit that job. Anyways he (father) ended up going to prison in 2003 for an assault charge and was released on 6/6/08. When I called to notify the AG's office they informed me that my case had been closed. When questioned why they told me that anytime the non custodial parent is in prison the cases get closed. That is new and absurd to me. Has anyone dealt with this or heard of this happening before? My son's father has pretty much gotten away with not paying support from 2001-2003 because he went to prison and the AG's office didn't act on it and now I have to go through the whole application process again.

I feel your pain

My ex owes over $70,000 in back support. I have been going through the OAG for years. I have yet to receive anything since 2002.He has been on probation several times. I was told it was a violation of probation to violate a court ordered child support. The probation officer seems to think other wise. Then he was arrested and sent to prison for several DUI I reported where he was only to be told my case is being closed. He was released on Aug 2 my case was closed on Aug 20. I don't think the Texas OAG even knows what they are doing!

Well If your stupid enough to go to prison then wtf are your kids to do and why should support end? would'nt you think it add up just like the deadbeat asses that don't pay anyways. duh get a life your probably a Parent who went to jail!!!!

I don't know what state you live in but I live in Mississippi and my ex has been in and out of jail for the better part of the 12 years we have been divorced and they have not closed my case. My ex is so stupid that he thought because he went to jail that he didn't have to pay...I was like "Oh Yeah, I forgot because YOU went to jail YOUR kids stopped living"??!! I was like wtf? I mean come on, can he really be that stupid? The state told him the same thing...he still has to pay...NOT THAT I'VE SEEN A DIME the whole 12 years that we have been divorced! The state is REALLY bad about forcing the child support issue, but I can't afford a lawyer so I am stuck with them! Sure hope they help soon! Did you also know that you can go for back child support up until the age your child turns 25...you have up to 7 years and your kids have even longer...the children can sue for back child support also! Nice to know!

Excuse me rude person, he is no longer in prison and is responsible for back child support.

Honey, it will be well worth going through the paperwork again to reopen your case. Good luck.

The ponit is that he was not meeting his obligations prior to being incarcerated. Prior to being incarcerated, he told me "I would rather go to jail then pay child support". Another point is with the state closing the case if he has a job (part of parole terms)it would take months to process the the case again and by the time that is done he probably will have lost his job. Like he had in the past. This man has NEVER supported his son (14 years old). Explain to me how an able bodied non incarcerated man would not want to support his child but yet make sure he has the most exsquisite cars and clothes for himself. You need to get real. To be honest I never expected him to pay nor do I need his money but because parents like yourself and him make idoitic comments(do you know what paying child support is going to do to me) to a parent that has been raising/supporting THEIR child by themselves they force the custodial parent to pursue help from the OAG. How real is that for you?
