Enforcing North Dakota Child Support Law
There are several methods that can be utilized by a non-custodial parent to pay his or her child support obligation. These methods include paying by check, income withholding, or automatic withdrawal. Of these, income withholding is the method most preferred by North Dakota Child Support Law and Enforcement Office. Income withholding means that child support payments can be deducted automatically by an employer from the non-custodial parent’s paycheck, just as taxes are deducted.
These funds can then be sent directly to the North Dakota State Disbursement Unit. In order to offset any of the costs incurred through this method, employers may deduct an additional $3 per month from the non-custodial parent’s paycheck.
If the income withholding method is not available (because the non-custodial parent is unemployed) or if the method is insufficient, the automatic withdrawal method can be used to collect funds from the non-custodial parent’s bank account.
In addition, the state can utilize a variety of enforcement methods to collect child support payments that are late or in arrears. These methods include wage garnishment, credit bureau reporting, license suspension (including driver’s, recreational, and occupational licenses), passport denial, liens on personal property, tax refund interception, and criminal prosecution. As of January 1, 2004, child support payments that are late will also accrue interest charges.
Reviewing North Dakota Child Support Law
If it has been at least three years since the child support order was reviewed or established, you can request a review from your Regional Child Support Enforcement Unit. A child support order review may be requested by either parent by writing to the Regional Child Support Enforcement Unit.
Accessing Information on North Dakota Child Support Law
North Dakota maintains an online database of case specific child support information. By completing a registration process using your State of North Dakota Login ID, Child Support Authorization Code, and Social Security number, you can access information about your case online.
Another method you can use to obtain instant information about your child support case is to contact North Dakota’s Interactive Voice Response system (IVR). This automated service can help answer many questions that you may have about your case. You can contact the IVR at (800) 231-4255 or (701) 328-5440.
