In the state of New York, either or both parents can be responsible for child support
NYS Child Support Laws
If the court sees that it is in the best interest of the child, New York State child support will allow both parents to agree on how much support will be paid. Both parents need to make sure that there is enough funds to cover medical, educational, and any additional expenses the child needs.
Wage Garnishments
When making child support payments, the state of New York is similar to most states in the U.S. Instead of sending the payments by mail every month, NYS child support will garnish the wages from the non-custodial parent’s paycheck. This procedure works well for both parents. For example, once payments are garnished, they are sent to a New York State agency where payments are verified then mailed to the custodial parent. When the wages are garnished, the custodial parent is guaranteed payments every month, and the non-custodial parent will have record of all payments that have been made.
Medical Insurance
Some states in America require that the non-custodial parent covers all the medical expenses. In the state of New York, either parent can be responsible for the medical coverage. The parent with the best medical plan from their employer are the ones the court generally orders to cover the medical expenses.
NYS Child Support Enforcement
To pay or not to pay? That is the question. If a non-custodial parent obeys the child support laws and makes timely payments, then that parent will be eliminated from any penalties. On the other hand, if the non-custodial parent refuses to pay, then he/she will face tough penalties that will motivate them to make future payments.
Income Tax Refund Confiscation
New York State will confiscate any tax returns at tax season for any overdue child support payments.
Unemployment Insurance Benefits
Most American have experienced the unfortunate event of loosing a job. For a non-custodial parent who is out of work and behind on child support payments will have their unemployment benefits deducted.
NYS Child Support Credit Bureau
No one likes bad credit, it makes it difficult to obtain a loan for a new car or even a home. Non-custodial parents who refuse to pay child support and are behind on payments, will be reported to the credit bureau.
Bank Accounts
Banks, a safe place where most, if not all Americans keep their money. Unfortunately not safe for non-custodial parents who do not make child support payments. NYS child support will seize any bank accounts or certificate of deposits (CD’s) from all non-custodial parents who fall behind on payments.
Drivers Licenses
NYS child support can suspend any New York State issued driver’s license if a non-custodial parent has overdue child support.
NYS Child Support Visitations
In the state of New York, a non-custodial parent will be able to visit their children at any time under the agreement with the custodial parent. However, if both parents can not come to an agreement, the court will issue the standard visitation rules. The non-custodial parent would be able to see their children every other weekend, one to one and a half months in the summer, and alternation holidays.
End of Child Support
Child support obligations end when the child reaches the age of twenty-one. Although, the child support laws state that the child will continue to receive support if the child is disabled.
