State Minimum

My ex is $22,000 past due in child support. He hasn't made a payment since Feb. 2008. The OAG finally got a court date last week. They couldn't get him served because he was dodging them. Even though they didn't serve him I was served and was told I had to show up to the court appearance. I waited for 4 hours before I finally just asked to leave because I knew he wasn't showing up. They told me that they would dismiss that court date and request a new date. The new date is 3 months from now. Why does it take so long? My ex played dumb as first like he didn't know about the court date (like he didn't know they were trying to serve him). I told him they were going to take him to jail if he didn't pay. He finally let something slip that he did in fact knew that there was a court date. He said the OAG would never take him to court for this because his brother never paid when his kids were little and that it was me that was taking him to court. Like what difference does it matter? He still has to pay the money. He doesn't have a job. He got fired from his real job in Feb. 2008. He works for friends that own their own business and gets paid cash on and off. He has also worked installing cable for Time Warner Cable. The OAG said on a job like that they cannot garnish his wages due to it's "contract employment” He had a wreck in June 2008 and when we talked about him not showing up for court last week he said he wants to go to court (but didn't show up) to tell the judge he can't work because his Dr hasn't released him. I told him that he can go to court and tell the Judge his sob story but the fact is if he isn't working due to medical reasons than he should be on disability. And also he was already $12,000 past due before the wreck happened. Some people have told me that if goes into court with this story I will get state minimum. I am trying to find out what that is? I have 3 kids. A friend said when her kid was little 15 years ago it was $167 a month. Is that times 3 kids or do you only get it for 1? Can someone please give me any information that you might have? Thanks!

You have the right under the law to intercept 55% of all disability your ex-husband is receiving in lieu of child support.
