Unattachable Income???

Hi,
My childrens father is over $10,000 in arrears on his support, with no payments in well over a year and a half. Being a nice person I didnt want to push this issue too hard, becuase I didn't want my choldren to be without their dad, during jail time. However, I after all this time and little help from him with the children I decided to push it legally with Ohio Child Support. I've called on 3 separte occassions to say I wanted it pushed. The first time, he was found in contempt for not showing to a court date, in November of 2009, I beleive. After that, nothing that I can see has been done other then CS sending out verfiications for wages. When I called yesterday CS told me to call back in 60 days. I asked why, becuase this was supposed to have been pushed to leagal long ago. They said when they sent out the most recent verification, he has unattachable income and therefore they cannot push the issue legally. I inquired what this unattachable income was and was told "if I could tell you, you would understand, but legally I cannot tell you". I became emotional and could not say anything further, other then uh huh and ok. I read over parts of the Ohio Reevised Codes and asked others for help with my confusion. What I would like to know is...

Explain to me how an unattachable income prevents a person from beign told they must make their child support payments without child support actually needing to garnish from pay. Why does this/an unattachable income prevent child support from taking legal action against him, for not paying his child support payments?

IT'S YOUR CASE GO INTO DOMESTIC, BE NICE AND get them to tell you in person, it's for your kids!!. It sounds like they mean he is working under the table, getting paid a 1099 (subcontractor tax form from employer, he pays his own taxes), therefore, it is "Unattachable Income" you need to talk to an attorney, find one that has the initial visit free for usually 1/2 or 1 hr. If he addmitted to domestic that he is working file for modification. Any 1099 work has to be on his tax return. Request that domestic files a proof of income with the IRS and get a copy of the tax return, not a hand written one from him. My ex works for himself and they won't look at his expenses which are a lot compared to the money he receives at his part time job, which he does to satify the courts. good luck!!!

google "child support statistics" and read all the various state regulations. I had just read that most states use the "maximum potential" employement and income approach. That means that regardless of "attachable" or "unattachable" income, the amount that would be used would be the "maximum" regardless of unemployed, underemployed, commissioned or any other "imcome" status.

It would be nice if I could give you some helpful advice: But I have no idea what is an Unattachable Income, What is sound like to me is for you to hire an lawyer with money I can only guess you don't have, and the Lawyer will talk over your head while you still have to pay him/her and still haven't recieve the child support that is not only needed but was most likely court order. I can only suggest this. What is it worth to you and your children? Only through the Grace of God you have gotten this far, and you will continue to get further;I'm not saying stop trying to get the support. The court is not helping and if it's safe to say THEY WON"T HELP those that need the help and these dead beats know how to work the system in their favor. Make sure the children are loved, encourage them and support them that they will and can be productive in LIFE. Don't talk negative about their dad He can do that ALL on his own. If it's worth it and you can afford it then yes hire an attorney. Research on your own ask question. Try the your city court library and the University law library and your local library.which has limited information. Search the web/google "child support what is unattachable Income". I can only Pray that things will work out-Sorry I couldn't help.
