On their website under FAQ's, is the question, Will the agency open a case to collect never assigned child support arrears if the child is emancipated? The answer is "NO".The Victorville California Child Support Agency has opened a claim for $32,000 for my ex-wife. My kids are 22,19 and 18. There reason for opening the case for the two emancipated childred is that youngest was 17 1/2 at the time the case was filed, so they could collect arrears for the two oldest. All my ex-wife had to do was sign an affidavit saying that I made partial payment for about 5 years. I can sign an Affidavit stating that I did pay child support in full. Instead the burden of proof is on me. The only problem is that I don't have the bank statements from 15 years ago to prove it. The banks only keep records back seven years. When we divorced I paid a moving company and physically helped her move in to an apartment. I have been in contact and involved in my kids lives to this day. Every birthday party, christmas, most basketball games and all graduations. There mother said she was struggling with finances an wanted me to continue to help her out. I did not agree and so she filed a claim. The original claim was for $72,000. But I produced most of my proof of payment. I have paid more than she would have received if I had only paid the minimum payments but I doubled the payments the last few years because they were teenagers and I knew that it was more expensive to raise them. I gave the a vehicle to get around in. I have purchased XBox machines,video game stereos, Ipod's,bicycles and many clothes. This is the thanks that I get from there mother. Just remember that the nice guys don't always win and keep records of every payment and purchase that you make. She can legally lie in California an get away with it if you protected yourself. Keep good records. There are many caring fathers out there with worse stories than mine. Don't be one of them.
