What's a father to do

by Wenchell
(Jacksonville, Fl, USA)

I am a father of a beautiful two year old daughter and I've been voluntarily paying 200 a month for the past year. I started by opening a bank account and depositing the money in the bank so the mother of my child can use the bank card. Due to my name was on the card and her current boyfriend didn't want to see my name she made send money in a different form. I started sending money through money gram because its the cheapest form of money order. She stated that she didn't know where any money gram locations were when in fact there is one in every Wal-Mart. So finally I sent the money through western union. I only make 7.50 an hour and I am on my own I could only afford to send 200. She took it upon herself to request more money and threaten to put me on Child support if I don't pay the additional money. I also don't get to spend time with my daughter like I want she has never spent a night with me. Also the mother of my child still lives at home with both her parents and grandmother so she is not the one looking after my daughter her parents are. My daughter is not in day-care and is potty trained. My email address is
godschild3192002@yahoo.com. I've been there for my daughter before she was born. what should I do?

You need a written order
by: PuebloNative

`Hey man:

I hate to say this to you, but as long as you have this informal child support agreement between you the greater chance that she can take you over the woodpile for child support. You need to go to court to get a custody and child support order. I hate to say this because of my own contentous relationship with our wonderful CSE system (and I say that with a ton of scorn), but the family court system does not recognize ANY payment outside of their bounds. They will consider all of those money orders you sent "gifts" and may even order back child support. Try to contact a lawyer and get any proof of payment that you have. At the very least, you need to get a written order for child support between you and you need to document every payment between you. Mark "For Child Support" in the memo field. and keep records of those money orders. Get that order set up and don't let her rake you over the coals like this.
