When does child support end?

My son has just turned 22 and has graduated from college. What are the laws, when child support ends. Does it end at 18? or does Texas law require payments be made until the child
graduates? I have been paying both current and back child support to the tune of $400 per month.
Can anyone tell me what the laws are for this? I moved to Michigan in 2000.

Prior to that, ex-wife hid child from me for 16 years, denying me my court ordered visitation.

Michigan says the child support ends at 18. So have I been paying child support for 4 years now when I should not have?



Hi Bill, In most states if the child is going to college and does not have a job, then the non-custodial parent is still obligated to pay child support. Now if the child finished high school and did not go to college, your obligations would end unless you owe any back child support.-Webmaster

In Texas, the usual requirement is to pay until the child turns 18 or graduates from high school (whichever is later). If there were a divorce decree, then it would have stated you had to pay through college too. But, you would have known about that. More than likely, you are paying back child support plus penalities and fees. For more information, google the Texas Attorney General's Office-Child Support Division. Also, look for the Texas Family Law. It will tell you all you need to know.

sometimes it doesn't end...

My step-son is known to reside outside of his (custodial) mother's home, has recently failed to graduate high school, has made no effort to obtain his diploma and is awaiting a court appearance for a recent arrest. Guess what? My husband is still paying. Dead-beat Dads??? Sometimes it's dead-beat kids!!!

Bill, with all due respect, review the 8 major federal child support laws and your state's laws yourself. That way you cannot be misled by anyone else. Take the necessary time to do this so that no one can take advantage of you, be it your ex-wife, the court or the system in general. At age 18, whatever you still owed in child support becomes arrearages and that gets 10% yearly judicial interest attached to it which can become substantial. If you STILL don't have it paid off when you apply for social security 65% of your monthly checks will be sent to your ex automatically, regardless of your health needs. You won't have anything to say about that. It's in YOUR best interests to pay it off now no matter what you have to do.
