Wife of a Man paying child support

My husband and I got together months after his x. Then she came up and said she was pregnant, needless to say it was his child. So he in high school still, gets a job to support his child. He takes diapers, food, clothes, money etc to the mother, living at home with her parents. She decides to draw more money from the gov. so they give it to her. Then they finally catch up and say who's kid is this where is the father. I told him over and over keep your receipts ---but no, she wouldn't do that to me. Well the state called him into court and ordered visitation and child support. On top of all of that he now had to pay back all the money she was drawing off the state PLUS you guest it interest. So the first 5 yrs of income tax returns all went to the interest i.e. gov. Then she decides to get married and run off. You fathers know what that means ....well we didn't see that child again till he was 15. That was only because he tracked us down after catching his mother lying to him about his "father".


So shortly there after he moved to Kansas with his grandparents, had enough of the terrible mother, finally. We have been fighting every since to get the child support changed over to Kansas BUT no one wants to listen. So his horrible mother with whom (he told us) he has suffered a great deal of abuse and step father, is now getting the money to raise their 2 kids while our 2 kids at home suffer and his son who is rightfully owed the support. Now this very month the child will be 18, what will he have to show for it. He came to us begging us to try to help him but they won't do anything about it. We like 90% of families today can't afford an attorney, so that will never happen.

Now we are struggling too and need to know when the child support will end. I've read till he is out of school, but what if he isn't even in school and no one will listen about where he lives then how will they listen about him being in school. Is there anyone who can help or that will?

My son lives in Kansas and his ex is primary of the 2 kids. Well shortly after the custody thing. Mom got both without an attorney.(???)His 4 yr old son was diagnosed with an inoperable brain tumor. Everytime he got sick dad brought him home. Then summer came for visitation and his son was bascially sick all summer. Mom only came once to see him in the hospital. Dad would take him to all doctor appts., stay in the hospital with him. Ex and dad came to an agreement for dad to keep him. He has had him since August and my son hasn't paid c/s since. Now he has had papers served for back childsupport. Mom never reported this to her srs caseworker. Mom gets assistance(don't work). He wants custody so bad, but this is about support. His son did start school this year so we do have prove of residencey. What else do we do here.

HI,

I read about this situation. Is the child living with his grandparents still?

How long has he NOT lived with his mother?

If he has been living with his grandparents longer then 6 months in a calender year there might be a way to get this stopped.

If the mother is still collecting child support, but the son is not living with her then she might be commiting fraud. Not only that if the grandparents are taking care of him and the mother is claiming him on her tax returns that is also fraud.

Please let me know more so I may be able to help steer you in the right direction with this problem.

The child support should end when he turns 18 if he has finished high school 19 if he is still in school. But if there are any child support payments in arrears they will keep collecting until he turns 21, after 21 they can't collect child support arrearages anymore unless the custodial parent goes to court before he turns 21 and asked the court to make the child support arreages a money settlement then it turns into a civil matter for collections and that can go on for ever until it is paid in full. But don't let his age fool you. You need to file in court to "terminate child support order" because he is of age. Then pray that the custodial parent isn't aware that they can drag the arrearages on past the age 21 if granted before they turn 21. I am going through somewhat of the same thing. THE FACT THAT YOUR HUSBAND IS THE NONCUSTODIAL PARENT HE CAN REQUEST A CHILD SUPPORT REVIEW WITH THE OFFICE OF THE ATTORNEY GENERAL. WHY DON'T YOU GO TO THE OAG WEB SITE AND CHECK IT OUT. YOU CAN ALSO FILE A COMPLAINT ONLINE WITH THE OAG(OFFICE OF THE ATTORNEY GENERAL)IT IS BETTER TO GO ONLINE THEN TO DEAL WITH THE OAG ON THE PHONE.IF INDEED HE HAS A CASE WITH THE OAG AND THE CHILD SUPPORT ORDER HAS BEEN THE SAME FOR 3 YEARS OR SO AND THE INCOME OF THE NONCUSTODIAL PARENT HAS INCREASED OR DECREASED BY 20%OR 100.00 DOLLARS, OR THERE HAS BEEN A SUBSTANIAL CHANGE IN CUSTODY HE CAN REQUEST A REVIEW. AT THAT TIME YOU TELL THE CS WORKER WHAT IS GOING ON THEN YOU DON'T HAVE TO HIRE AN ATTORNEY.
