Withholding Employer Not Sending Child Support

My ex finally has a job and we are working with the OAG to get his child support where it should be. When the kids were litle, my ex didn't work after the divorce, and he never took the responsibility to let the state of MI know it, so he has ended up with arrearages of $50,000. He was in TX, so MI had no way to get us the child support. During that time, I worked and went to school so I could better myself and have the ability to take care of my family on my own.

Flash forward to 2007, the kids and I move to TX for a job. My ex was working and paid me $250 a month, which I let the state of TX know when we file the paperwork to move the case to TX. TX still cannot take jursidiction three years later because my ex apparently owes the state of MI $600. So, we have TX doing a withholding order of $600 a month to take care of the CS and part of the arrearages. Now, his boss is having trouble with his business, and my ex is not educated enough of has taken care of himself well enough to be able to get another job (ie he would have to get dentures, etc.) and his current employer pays for his cell phone and his car, so the boss still withholds the money from my ex's paycheck, while at the same time does not always send it to me. We're only at 5 months now, so it's only $3000 but I also based my budget upon the CS I was receiving.

I am one of the lucky one's who is able to use the CS to help pay for extra-curricular things, like my son's saxophone or my other son's driver's education. But that is after I am able to pay rent, etc. I don't get to not pay for my son's instrument just because I was short on the child support this month. So, then I have to pay for those obligations on top of the regular bills, which in turn kills the budget for food or other non-luxury items.

The OAG's response was they will send him a letter in a couple more weeks when they try to work on enforcement again, now that they have moved the case to yet another office.
