Workers Compensation NOT Subject to Garnishment.

Here is an email exchange between Orange County Child Support Services and Myself when two child support payments were not sent.

Good afternoon Mr. N,

This email is in regards to your earlier call to the Child Support Services office.

I have contacted the workers compensation insurance company to follow up on this months payment and left a message. Typically our office does not follow up on payments before they are late. Ms. XXXXX has until the last day of the month to make a payment. I will let you know when I hear back from the insurance company.

Child Support Enforcement Team,

It may be of interest that the WC Insurance company issued 2 compensation payment checks to Ms XXXXX during October 2010 that were the consistent in the amount normally sent to her. The checks do not show the deduction(s) for child support. But they never show the deductions.
My point is that she never receives any accounting.
Therefore, I suspect that the child support has been misdirected. Ms XXXXX will then be charged with arrears, and payment will never be received here.
The error, in my opinion, is with the insurance company or OCCS.

I have been in contact with the insurance adjustor, the type of disability Ms. XXXXX is now receiving has changed and is not subject to child support garnishment. Our office has placed a lien in order to collect from any settlements.

Would you please quantify the type? ie TTD, PTD etc.

Yes I cut and pasted this email conversation. and...no there has been no further reply to my last question.
Is there something NOT right with this?
Wage assignment has been in place and enforce up until now.
No notice or warning was sent and the explanation from the Enforcement Team seems insufficient and possibly not correct.
No support has been received since September.
Arrears are approaching $10K.
