Well my story begings with a failed relationship where we agreed to visitation and she decided that she was not going to abide by it. So I took her to court in 2008. After the trial we both were granted joint custody alternating week and I paid child support. Well over the next three years I had child services called on me; which was found untrue, an exparte (order of protection)placed against me; which was dimissed,denied visitation for about six months had to spend several thousand dollars on Attorney fees causing me to dip in to savings and eventually placed me behind on payments. Once I was behind on payments she filed failure to pay in her state of Tennessee and in my state Arkansas. Because of this I show two debts for child support on my credit report. Well I was granted custody of my children the court order stated that the back payments that I occured from having to constantly take her to court and defend my self be paid by crediting what she would pay me for child support until the balance is paid. Well Tennessee her current state of residence proceeded to take my federal taxes after the judge in Arkansas ruled on how it is paid back. I filed an appeal with the state of Tennessee. Got a call to try an informal remedy. During the call I was berated by the Maximus employee and was told that well the order covers your payments, but we are still taking your tax refund because the mother commited benefits fraud. I told them that had nothing to do with me and they need to get their money from her. I was told that they will not take money from her taxes or anything you are responsible. Keep in mind I have custody of the children now and have provided medical and financial support from day one.
